2.3 SSL or TLS encryption

This site uses SSL or TLS encryption for security reasons and to protect the transmission of confidential content, such as orders or inquiries that you send to us as the site operator. You can recognize an encrypted connection by the fact that the address line of the browser changes from "http://" to "https://" and by the lock symbol in your browser line. 3.1 General information on data collection & data processing

When processing your personal data, we comply with the provisions of the GDPR and all other applicable data protection regulations. The legal basis for data processing arises in particular from Art. 6 GDPR. 

We use your data to initiate business, to fulfill contractual and legal obligations, to implement the contractual relationship, to offer products and services and to strengthen the customer relationship, which may also include analyses for marketing purposes and direct advertising. 

Your consent to data processing may also constitute a data protection authorization provision. Before you give your consent, we will inform you about the purpose of the data processing and your right to withdraw consent. 

If the consent also relates to the processing of special categories of personal data, we will expressly point this out to you in the consent. Processing of special categories of personal data pursuant to Art. 9 GDPR is otherwise only carried out if this is required by law.

From time to time, we also base data processing on our legitimate interest in accordance with Art. 6 para. 1 sentence 1 lit. f GDPR, e.g. when using fraud management tools.

Disclosure to third parties

We will only pass on your data to third parties within the framework of the statutory provisions or with the appropriate consent. Otherwise, it will not be passed on to third parties unless we are obliged to do so due to mandatory legal provisions (disclosure to external bodies such as supervisory authorities or law enforcement authorities). 

Recipients of the data / categories of recipients

Within our company, we ensure that only those persons receive your data who need it to fulfill contractual and legal obligations. In certain cases, service providers support our specialist departments in the fulfillment of their tasks. The necessary data protection contracts were concluded with all service providers. 

Transfer to a third country / intention to transfer to a third country

Data will only be transferred to third countries (outside the European Union or the European Economic Area) if this is necessary for the performance of the contractual relationship, is required by law or if you have given us your consent to do so. 

We would also like to point out that your data may be processed outside the European Union. Appropriate contractual regulations and guarantees ensure compliance with the European level of data protection for data transfer and processing in third countries. Data processing or storage in third countries may also take place on the basis of your consent (Art. 49 para. 1 sentence 1 lit. a GDPR), in which case you will be informed of this separately when your consent is obtained, as well as the possibility of revocation.

Storage duration of the data

We store your data for as long as it is required for the respective processing purpose. Please note that numerous retention periods mean that data (must) continue to be stored. This applies in particular to retention obligations under commercial or tax law (e.g. German Commercial Code, German Fiscal Code, etc.). If there are no further retention obligations, the data will be routinely deleted once the purpose has been achieved. 

In addition, we may retain data if you have given us your permission to do so or if legal disputes arise and we use evidence within the framework of statutory limitation periods, which can be up to thirty years; the regular limitation period is three years. 

Secure transfer of your data

We use appropriate technical and organizational security measures to protect the data stored by us against accidental or intentional manipulation, loss, destruction or access by unauthorized persons. The security levels are continuously reviewed in collaboration with security experts and adapted to new security standards.

The exchange of data to and from our website is encrypted. We offer HTTPS as the transmission protocol for our website, in each case using the current encryption protocols. It is also possible to use alternative communication channels (e.g. by post).

Obligation to provide the data

There is a contact form on our website that can be used to contact us electronically. If you write to us via the contact form, we will process the data you provide in the contact form to contact you and answer your questions and requests, Art. 6 Para. 1S. 1 lit. a, b GDPR. 

The principle of data minimization and data avoidance is observed in that you only have to provide the data that we absolutely need to contact you. These are your e-mail address, surname and first name, company and the message field itself. In addition, your IP address is processed for technical reasons and for legal protection. All other data are voluntary fields and can be entered optionally (e.g. to answer your questions more individually). 

In order to protect the security and confidentiality of your data in the best possible way, we implement appropriate security measures. Your request will be transmitted to us in encrypted form.

If you contact us by e-mail, we will process the personal data provided in the e-mail solely for the purpose of processing your request. If you do not use the forms offered to contact us, no further data collection will take place. 

If your enquiry relates to a complaint, warranty claim or similar, we will also transfer this data together with your personal details to the distributor from which you purchased the device, or to another distributor near you so that your request can be dealt with.

3.4 We collect and process the following data for newsletters:

You can subscribe to a free newsletter on our website to receive regular information about our products, new products and special offers. The e-mail address and your name provided when registering for the newsletter will be used to send you the personalized newsletter. 

The principle of data minimization and data avoidance is observed here, as only the e-mail address (or name in the case of personalized newsletters) is a mandatory field is marked. For technical reasons and for legal protection, your IP address is also processed when you subscribe to the newsletter.

We use the so-called double opt-in procedure for sending newsletters by e-mail. This means that you will only receive advertising by e-mail if you have previously expressly confirmed that we should activate the newsletter service. We do this by sending you a notification e-mail and asking you to confirm that you wish to receive our newsletter at this e-mail address by clicking on a link contained in this e-mail.

You can of course unsubscribe at any time using the unsubscribe option provided in the newsletter and thus revoke your consent. It is also possible to unsubscribe from our newsletter at any time directly via our website. 

The services of MailChimp are used to send newsletters. The provider is Intuit Mailchimp, 405 N Angier Ave. NE, Atlanta, GA 30308 USA. MailChimp is a service that can be used to organize and analyse the sending of newsletters, among other things. If you enter data for the purpose of subscribing to the newsletter (e.g. e-mail address), it will be stored on MailChimp's servers in the USA.

With the help of MailChimp we can analyze our newsletter campaigns. For this purpose, we use technologies that record how users read our newsletter, which information is clicked on particularly frequently and which is not. The purpose is to optimize our newsletter so that it is even more appealing, easier to read and more informative for you. The data collected is stored anonymously and is not assigned to your person. The data collected is of a purely statistical nature, as it is only collected anonymously and is not linked to your other personal data.

The necessary contract for data processing by Intuit Mailchimp has been concluded.

If you do not wish to be analyzed by MailChimp, you must unsubscribe from the newsletter. You will find a link to cancel your subscription at the end of each newsletter or you can send an informal message via the contact form or send an e-mail to our data protection officer.

The data processing is based on your consent (Art. 6 para. 1 sentence 1 lit. a GDPR). You can revoke this consent at any time by unsubscribing from the newsletter. The legality of the data processing operations already carried out remains unaffected by the revocation.

3.5 Processing of data (customer and contract data)

We process the following data in customer contact:

We collect, process and use personal data only insofar as it is necessary for the establishment, content or modification of the legal relationship. This is done on the basis of Art. 6 para. 1 p. 1 lit. b GDPR, which permits the processing of data for the performance of a contract or pre-contractual measures.

In order to avoid bad debts, we may, depending on the means of payment you choose, on the basis of Art. 6 para. 1 sentence 1 lit. f GDPR, in accordance with our legitimate interest, after you have placed an order, we may transmit your data to Coface Finanz GmbH, Isaac-Fulda-Allee 1, 55124 Mainz, Germany, for a credit check. A credit check uses a mathematical procedure to calculate a so-called score value, which provides information about your ability to pay. This usually happens as soon as a credit limit of 1.000 € is exceeded. We would like to point out that Coface Finanz GmbH uses the transmitted data for its own purposes. You can object to the transmission of this data to Coface Finanz GmbH at any time, but it may then not be possible to execute the purchase contract.

The customer data collected will be deleted after completion of the order or termination of the business relationship. Statutory retention periods remain unaffected.
 

3.6 Applicant portal 

We collect and process the following data for online applications:

Thank you for your interest in working for the Wagner Group. We are aware of the importance of your data and process the personal data you provide in the application form only for the purpose of effective and correct handling of the application procedure and for contacting you as part of the application process.  No data will be passed on to third parties without your consent. 

You will be asked to provide personal data as part of the application form. We observe the principle of data minimization and data avoidance in that you only have to provide us with the data that we need to fully review your application documents, e.g. your CV, or that we are legally obliged to collect. This mandatory information is marked with an * (asterisk). Your IP address is also processed for technical reasons and for legal protection.

Unfortunately, we cannot check your application documents without this data, which is why our application system will not allow you to upload your application documents in this case. Of course, you have the option of providing voluntary information in the application form. The legal basis for this is Art. 6 para. 1 p. 1 lit a, b GDPR. As a service provider, we use SAP SuccessFactor, developed by SAP Deutschland SE & Co. KG, Hasso-Plattner-Ring 7, 69190 Walldorf, Germany. 

In order to protect the security and confidentiality of your data in the best possible way, we implement appropriate security measures. Your application documents will be transmitted to us in encrypted form via our application system.

We store your data for the above-mentioned purposes until the application process has been completed and the relevant deadlines have expired - at the latest six months after receipt of a decision. In the case of an unsolicited application, you have the option of us saving your application documents for six months and comparing them with other vacancies that match your profile. For this we need your consent, which you can give us by clicking on the checkbox before uploading your application documents. We use Pinterest tags on our website, which are provided by Pinterest Europe Ltd. When you call up a page that contains such a code snippet, the browser establishes a direct connection to the Pinterest servers. The plugin then transmits log data to the Pinterest server in the USA. 4.6 Meta Pixel

Our website uses the visitor action pixel from Meta Platforms Ireland Limited, Merrion Road, Dublin 4, D04 X2K5, Ireland to measure conversions.

We use this to measure the success of our advertising campaigns by tracking the behavior of website visitors after they have been redirected to our website by clicking on a Facebook ad. The behavior can be evaluated for statistical and market research purposes and future advertising measures can be optimized. The legal basis for this is your consent in accordance with Art. 6 para. 1 p. 1 lit. a GDPR.

4.7 Facebook Conversion API

This website uses, if you consent to this in accordance with Art. 6 para. 1 p. 1 lit. a GDPR, the so-called Conversions API of the social network "Facebook" of Meta Platforms Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland (Meta), an interface between our marketing data and the systems of Facebook. With this use, we want to ensure that the ads we place via Facebook correspond to the interests of our users. This provides us with statistical evaluations that allow us to track the behavior of users on our website and their interaction with our content. On our website, we use the TikTok Pixel in combination with the Events API, which is operated by TikTok Technology Limited, 10 Earlsfort Terrace, Dublin, D02 T380, Ireland. It is used to optimize and further develop advertising campaigns so that we can display advertising in a more targeted manner. 

For this purpose, data on the use of the website and the logging of clicks on individual elements are recorded in order to display the appropriate advertising according to user behavior. 5.8 Sentry

We use the error monitoring tool Sentry on our website in order to quickly identify, diagnose and rectify problems with our website. Sentry is a tool from Functional Software, Inc, 45 Fremont Street, 8th Floor, San Francisco, CA 94105 and is hosted and operated by us in the open source version on our servers. We evaluate error messages with the help of Sentry. We collect and process usage data such as the URL called up, the status of the website and technical data such as browser information and IP address.

We process this data on the basis of our legitimate interest within the meaning of Art. 6 para. 1 p. 1 lit. f GDPR in order to continuously improve our systems and to prevent security gaps.

First and foremost, we process the personal data that we receive or have collected from the data subjects as part of the business or customer relationship. We also process data provided on the basis of inquiries / visits / registrations (e.g. Internet store), consents (e.g. newsletter dispatch) etc. within the legally permitted framework. 

In addition, we also process personal data that is made available to us as part of order processing and also data from publicly accessible sources (e.g. press, Internet), insofar as this is necessary and permissible for the respective purposes. We also process personal data that is transmitted to us by other companies in the Wagner Group or by third parties (e.g. credit insurance, receivables management, information on criminal acts) with permission. 

The personal data processed by us in this context consists of personal data / identification data (name, address, contact details, user ID, etc.), Data from the fulfillment of our contractual obligations (bank data, history, authorizations, etc.), Data provided to us in the context of consents and other data comparable to the categories mentioned.

The processing of personal data is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract. Insofar as you have consented to certain processing of your personal data (e.g. newsletter dispatch, participation in advertising campaigns), the lawful processing of your personal data is based on this consent. You may revoke consent you have given at any time with future effect. This shall also apply for declarations of consent you gave us before the GDPR came into force, namely prior to 25 May 2018. Since the revocation of consent applies to the future, it does not affect the effectiveness of the processing up to the time of revocation.

4. Statutory or legal requirements (Article 6 para. 1 lit. e GDPR)

In addition, various legal obligations apply to us as a company (e.g. tax laws, money laundering law). This includes identity checks, fraud and money laundering prevention, the fulfillment of tax control and reporting obligations as well as the assessment and management of risks within the company and the Wagner Group.

The company guarantees the implementation of appropriate technical and organizational measures for data security through internal regulations and - if the data is processed by an external service provider - through corresponding contractual agreements, for example by using the EU standard contractual clauses for data processing outside the European Union. Please notify any necessary changes in your data in good time. You can clarify questions about your data via the relevant departments or the data protection officer and request both information and the correction/deletion of incorrect data or data that is no longer required.

In addition, personal data is transferred to bodies in third countries in the following cases:

• With the consent of the data subject or on the basis of legal regulations to combat money laundering, terrorist financing or other criminal acts and on the basis of a balancing of interests, personal data is transmitted in individual cases in compliance with the data protection level of the European Union.

• Fulfillment of legal retention periods (e.g. German Commercial Code (HGB), German Banking Act (KWG), German Money Laundering Act (GwG). The retention periods specified therein are typically between 6 and 10 years.
• Fulfillment of justified retention periods (e.g. for customer service, inquiries, log files).
• Preservation of evidence within the statutory limitation rules. According to §§ 195 ff. of the German Civil Code (BGB), these limitation periods can be up to 30 years. The regular limitation period is 3 years If we or a third party process your data on the basis of the above-mentioned balancing of interests, we will delete your personal data as soon as our legitimate interest no longer exists. The above-mentioned exceptions also apply here, and data is deleted as part of the deletion routines implemented by the process owners.
  In the case of consent, the data shall be erased as soon as future consent is revoked unless one of the above-mentioned exceptions applies.

To protect against the various threats to our IT - e.g. malware, hacker attacks, spam - and intellectual property, various procedures are used in which the information exchanged is checked for viruses, for example, and the connection data is examined for anomalies. Should any vulnerabilities be detected, the documents and connection data in question can be analysed. In order to comply with existing delivery and payment restrictions - for example to companies and persons listed in various government lists - a comparison can be made against this list.  In addition, in cases of suspicion, in official investigations and to defend against claims against our company, an investigation and, if necessary, the disclosure of data and documents relating to the persons concerned may be necessary. In all cases, our internal regulations, the legal requirements and the personal rights of the data subjects are observed.

According to Article 15 GDPR, every data subject has a right of access. In accordance with Article 16 GDPR, the data subject may request the rectification of inaccurate personal data. Pursuant to Article 17 GDPR, the data subject has a right to erasure or, pursuant to Article 18, a right to restriction of processing. The data subject may also object to the processing of their personal data under the conditions set out in Article 21 GDPR. In accordance with Article 20 GDPR, the data subject has a right to data portability. To assert these rights, you can contact the data protection officer or the relevant department: In addition, in accordance with Article 77 GDPR in conjunction with Section 19 BDSG, you have the right to lodge a complaint with the competent data protection supervisory authority, and you can withdraw your consent at any time.

Within the scope of the legal transaction to be carried out with you, you are obliged to provide the personal data that is necessary for the execution of the legal transaction and for the fulfillment of the associated contractual obligations or that we are legally obliged to collect.  If you do not provide certain personal data, you may suffer disadvantages or the legal transaction may not be concluded.

Automated decisions can only be made in accordance with Article 22 GDPR if they are necessary for the conclusion or performance of a contract or are permitted by law or are legitimized by the express consent of the data subject. If we use such procedures in individual cases, you will be informed about this and about your associated rights within the framework of the legal requirements.

Some of your data is processed automatically in order to evaluate certain personal aspects (profiling). For example, we are obliged by legal and regulatory requirements to combat money laundering, terrorist financing and criminal offenses that endanger assets. Data evaluations are also carried out in this context.
